Terms of Service
These terms are a working draft. They have not been reviewed by a lawyer. Have them checked before the public App Store launch, particularly the liability and consumer-rights sections — EU consumer law limits what a business can disclaim against a consumer, and an unenforceable clause is worse than none.
1. Who you are agreeing with
MintChip ("the app") is operated by MkStudios – Mario Koll, Drosselweg 5/2, 4030 Linz, Austria ("we", "us"). Full company details are in our Impressum. By creating an account or using the app you agree to these terms. If you do not agree, please do not use the app.
2. What MintChip is — and is not
MintChip is a habit and behaviour app. It helps you notice and adjust patterns in what you eat and drink by way of a points system.
MintChip is not a medical device, and nothing in it is medical advice. It does not diagnose, treat, or prevent any condition. The coin values, Treat Balance, Focus Quests, Insights and Coach responses are behavioural guidance, not clinical recommendations, and they are not a substitute for a doctor, dietitian, or therapist.
If you have a medical condition, are pregnant or breastfeeding, take medication that interacts with diet, or have a history of an eating disorder, consult a qualified professional before changing how you eat. If using the app makes your relationship with food worse, please stop using it.
3. Your account
You need an account to use the app. You agree to give accurate sign-up information, to keep your credentials to yourself, and to tell us if you think someone else has access to your account. You are responsible for what happens under your account.
You must be at least 13 years old to use MintChip. If the age of digital consent where you live is higher, that age applies instead.
4. Acceptable use
Please do not:
- Try to manipulate your coin balance, or interfere with how coins are calculated;
- Attempt to access another user's data, or any part of our systems you are not meant to reach;
- Reverse engineer, decompile, or scrape the app or its backend, except where the law says you may;
- Upload anything unlawful, or any image containing another person who has not agreed to it;
- Use the app to build a competing product, or resell access to it.
We may suspend or close an account that does these things.
5. Your content
What you log — your entries, notes, and any photos — stays yours. You give us only the permission we need to operate the app for you: to store your content, process it (including the AI processing described in the Privacy Policy), and show it back to you. We do not sell your content, and we do not use it to advertise to you.
6. Treat Coins have no monetary value
Treat Coins and your Treat Balance are a feature inside the app. They are not currency, not credit, not a security, and not redeemable for money or goods. They cannot be transferred, sold, or cashed out, and they carry no value outside the app. We may adjust how coins are earned and spent as we tune the system, including for balances you already hold.
7. Beta software
MintChip is in beta. It may contain defects, behave unexpectedly, or change substantially between versions. Features may be added, changed, or removed. We try hard not to lose data, but during the beta you should not treat the app as your only record of anything you would be upset to lose — the export function is there for that.
8. Availability
We aim to keep the app running but do not promise uninterrupted availability. Parts of the app depend on third-party services (see the Privacy Policy), and we may need to suspend the service for maintenance or for reasons outside our control.
9. Price and payment
MintChip is currently free to use, with no paid subscription available. If we introduce paid features, we will say so clearly, purchases will run through Apple's In-App Purchase system under Apple's terms, and we will not convert an existing free feature into a paid one without notice.
10. Ending it
You can stop at any time by deleting your account in Settings → Data & Privacy → Delete my account, which erases your data as described in the Privacy Policy. We may terminate or suspend access if you materially breach these terms, or if we discontinue the app — in which case we will give you reasonable notice and time to export your data.
11. Liability
The app is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, or for outcomes arising from decisions you make about your diet or health while using the app.
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected by anything written here.
12. Changes to these terms
We may update these terms. If a change is material, we will tell you in the app or by email before it takes effect. Continuing to use the app after that means you accept the new terms.
13. Law and jurisdiction
These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Linz, Austria.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, nor of your right to bring proceedings in the courts there.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Consumers in Austria may contact the Internet Ombudsstelle (ombudsstelle.at), an independent conciliation body for online disputes.
